In over thirty lines of the Agamemnon I think I discern lurking in the apparatus of modern editions truths unnoticed by recent editors, and needing for the most part merely redivision, repunctuation, or reaccentuation to become recognizable. At a few points I offer alternative interpretations of readings that have been accepted by some at least among modern editors.

This paper argues that the concept and role of ‘institutional racism’ in contemporary discussions of race should be reconsidered. It starts by distinguishing between ‘intrinsic institutional racism’, which holds that institutions are racist in virtue of their constitutive features, and ‘extrinsic institutional racism’, which holds that institutions are racist in virtue of their negative effects. It accepts intrinsic institutional racism, but argues that a ‘disparate impact’ conception of extrinsic conception faces a number of objections, the most serious being that it (...) has no plausible account of what it is that makes extrinsically racist institutions racist. It also argues that claims about the explanatory indispensability of institutional racism are overstated (individual racism is at least as important), critiques structural approaches to racial inequality, and suggests that there is reason to doubt whether institutional reform can provide us with all that morality may require in the racial domain. Mencius, who lived in the 4th century B.C., is second only to Confucius in importance in the Confucian tradition. The _Mencius_ consists of sayings of Mencius and conversations he had with his contemporaries. When read side by side with the _Analects_, the _Mencius_ throws a great deal of light on the teachings of ConfuciusMencius developed many of the ideas of Confucius and at the same time discussed problems not touched upon by Confucius. He drew out the implications of Confucius' moral (...) principles and reinterpreted them for the conditions of his time. As the fullest of the four great Confucian texts, the _Mencius_ has been the required reading amongst Chinese scholars for two thousand years, and it still throws considerable light on the character of the Chinese people. D.C. Schindler reminds us that the motto of Villanova consists of three terms: Unitas, Caritas and Veritas. Postmodern philosophy is keen to malign good Veritas as an exercise in oppression, something which must be avoided if we truly want to reach universal care and unity. In opposition to this trend, Schindler illustrates how Desmond’s philosophy is capable of giving truth its dues against the assaults of Vattimo and others, but also and more importantly that truth serves as foundational for unity (...) and care. Building from Desmond’s Intimate Universal, Schindler illustrates how care and unity need an ontological grounding in truth in order to be more than merely superficial. (shrink)

The development of transplantation technology increasingly places before society a multitude of diverse, complex ethical and legal problems. The subject is the more complex because of the various divergent interests involved. There are the interests of the donor of organs, who has a right to protection of his legal position, and those of the patient in need of an often lifesaving organ. There are also the interests of the donor’s relatives, after his death, and those of the transplantation surgeons. The (...) international dimension of transplantation technology makes the picture even more complicated. Though this article is devoted to the European situation, the problems are similar all over the world. (shrink)

Phidias’ absence from the survey of sculptors in Cic. Brut. 70 is curious, explanation in terms of differing histories of sculpture only partly convincing. I suggest that Cicero has valid literary motives and is wittily undermining the Atticist position by adaptation of what was a rhetorical topos, the parallel development of Greek prose and sculpture from archaic spareness to classical expertise and dignity: see Dem. Eloc. 14, D. H. Isoc. 3, p.59 U-R; more elaborate but partly deriving from Cicero and (...) less homogeneous is Qu. 12.10.7–9. Cicero assumes the reader's knowledge of the commonplace, pointedly ignores the quality of grandeur and dignity, and develops a theory of technical progress on the basis of veritas and grace to attack the Atticists from their own preferences. The resulting model serves to demote Lysias, imitated by the Atticists but merely the counterpart of Calamis, strigosior like archaic sculptures and superseded by later progress. The analogy thus obliquely repeats the brief but charged parenthesis in 66 that Demosthenes superseded Lysias. (shrink)

This intervention queries whether subjecting feminist jurisprudence to a methodological transfiguration toward pragrammatology (Derrida, in Smith and Kerrigan 1984) holds liberating potential for f (be it ‘woman’, ‘female’ or ‘feminine’) as both a signifier and a subject to be read with lucidity and nuance in feminist justice claims. I examine feminist jurisprudence’s methodological challenges in the settler colonial context of Alaska with respect to the murders of Della Brown (in 2000) and Mindy Schloss (in 2007). I advance my case for (...) pragrammatology as a critical methodology for feminist jurisprudence by subjecting the case(s) of Brown and Schloss to a more lucid (re)reading in two related and intersecting moves. First, I trace and deconstruct the citations of Brown and Schloss’ legal narratives to expose violence in the systemisation of f as a power and legal relation (Ahmed in Soc Legal Stud 4:55–73, 1995). I then examine the paradoxical nature of f justice claims which necessitate a pragrammatological approach. I conclude by advancing counsel on how we might move within paradox. (shrink)

In his historical writings, Cluvius Rufus evidently found cause to criticize Verginius Rufus for his conduct on a particular occasion ‘Scis, Vergini, quae historiae fides debeatur; proinde, si quid in historiis meis legis aliter ac velles, rogo igmoscas’. From his reply, it is clear that Verginius automatically understood Cluvius to be referring to an event to which he himself attached great significance: ‘Tune ignoras, Cluvi, ideo me fecisse, quod feci, ut esset liberum vobis scribere quae libuisset?’.

A record of the words and teachings of Confucius, _The Analects_ is considered the most reliable expression of Confucian thought. However, the original meaning of Confucius's teachings have been filtered and interpreted by the commentaries of Confucianists of later ages, particularly the Neo-Confucianists of the Song dynasty, not altogether without distortion.In this monumental translation by Professor D. C. Lau, an attempt has been made to interpret the sayings as they stand. The corpus of the sayings is taken as an organic (...) whole and the final test of the interpretation rests on the internal consistency it exhibits. In other words, _The Analects_ is read in the light of _The Analects._This results in a truer understanding of Confucius' thought than the traditional interpretation and paves the way for a re-assessment of its importance in the history of Chinese thought and its relevance to the present day world.This volume also contains an introduction to the life and teachings of Confucius, and three appendices on the events in the life of Confucius, on his disciples, and on the composition of _The Analects._. It is commonly observed that behind many of the political and cultural issues that we face today there are impoverished conceptions of freedom, which, according to D. C. Schindler, we have inherited from the classical liberal tradition without a sufficient awareness of its implications. Freedom from Reality presents a critique of the deceptive and ultimately self-subverting character of the modern notion of freedom, retrieving an alternative view through a new interpretation of the ancient tradition. While many have critiqued the inadequacy (...) of identifying freedom with arbitrary choice, this book seeks to penetrate to the metaphysical roots of the modern conception by going back, through an etymological study, to the original sense of freedom. Schindler begins by uncovering a contradiction in John Locke's seminal account of human freedom. Rather than dismissing it as a mere "academic" problem, Schindler takes this contradiction as a key to understanding the strange paradoxes that abound in the contemporary values and institutions founded on the modern notion of liberty: the very mechanisms that intend to protect modern freedom render it empty and ineffectual. In this respect, modern liberty is "diabolical"--a word that means, at its roots, that which "drives apart" and so subverts. This is contrasted with the "symbolical" (a "joining-together"), which, he suggests, most basically characterizes the premodern sense of reality. This book will appeal to students and scholars of political philosophy (especially political theorists), philosophers in the continental or historical traditions, and cultural critics with a philosophical bent. The German philosopher Robert Spaemann is one of the most important living thinkers in Europe today. God and the City, based on the Aquinas Lecture delivered at the University of Dallas in 2022, aims to think about politics ontologically. In other words, it seeks to reflect on, not some political theory or other, nor on the legitimacy of political action or the distinctiveness of particular regimes, but on the nature of political order as such, and how this order implicates the fundamental questions of existence, those concerning man, being, and God. Aristotle, and Aquinas after him, identified (...) metaphysics and politics as "architectonic" sciences, since each concerns in some respect the whole of reality, of which the particular sciences study a part. Chapter one of this book argues that, just as metaphysics, in studying being as a whole, cannot but address the question of God in some respect, so too does politics, the ordering of human life as a whole, necessarily implicate the existence of God. In this regard, the modern liberal project has deluded itself in attempting to render religion a private, rather than a genuinely political, matter. We cannot organize human existence without making some claim, whether implicitly or explicitly, about the nature of God and God's relation to the world. The second chapter approaches this theme from the anthropological dimension. As Plato affirmed, the "city is the soul writ large": if man is religious by nature, he cannot be properly understood, and the human good cannot be properly secured and fostered, if the "God question" is "bracketed out" of the properly political order. Moreover, if we fail to recognize the essentially political dimension of relation to God, we will be unable properly to grasp the presence of God in the (ecclesial and sacramental) Body of Christ: God cannot be real in the Church as Church unless he is also real in the city as city (and vice versa). In his De regno, Aquinas famously affirms that "the king is to be in the kingdom what the soul is in the body and what God is in the world." Chapter three offers a careful study of the body-soul relationship in order to illuminate, on the one hand, the nature of political authority, and, on the other, the precise way that God is present in human community. Recalling the “memory of God” is arguably what Benedict conceived to be the central mission of his papacy, and by that he meant recovering a sense of the primacy of God, not just in matters of private faith, but as a fundamental principle ordering the whole of human existence. In this respect, one can imagine that Benedict would have been heartened to see the new book by R. Jared Staudt, The Primacy of God: The Virtue of Religion in Catholic Theology, which draws not only on Joseph Ratzinger, but also Hans Urs von Balthasar, Christopher Dawson, and, most fundamentally, Thomas Aquinas, to show, indeed, that there is nothing more fundamental than religion.What prompts the need for such an effort is the pervasive sociological reduction of religion in the contemporary imagination to a culturally conditioned set of beliefs and practices that concern God, the divine, or in any event the “afterlife.” In other words, religion is wholly immanentized, understood as an essentially human contrivance, by which man attempts to relate himself to what he takes to be God. It is just this interpretation that lies behind the general assumption of the phenomenon of “religious pluralism”: the world is made up of a potentially infinite number of “different religions,” all of which must be “tolerated” (i.e., must be relegated to a circumscribed social space that renders them more or less politically innocuous) because they offer no rational basis for any sort of arbitration. In contrast to the more typically Protestant response to this “humanistic” reduction of religion, exemplified by Karl Barth, which would insist that Christianity is not “a religion,” Staudt attempts to recover a more robust tradition that recognizes both the deep natural roots of religion and the supernatural distinctiveness of Christianity. To do so, he wisely adopts what he calls a “ressourcement Thomist” approach, but what we might call a genuinely Catholic—and catholic—perspective, namely, one that affirms Thomas Aquinas as a culminating figure of the classical Christian tradition, rather than as one [End Page 685] current of that tradition that defines itself principally in contrast to other currents. In other words, Staudt reads Aquinas in light of Scripture, the Fathers of the Church, and classical philosophy, on the one hand, and in positively disposed engagement with more recent thinkers, such as Ratzinger and Balthasar, on the other. In treating such a fundamental theme as religion, it is especially fitting to attempt to take a fundamental, rather than a “partisan,” approach.The book falls into three basic parts. Tacitus writes that, by insisting that legionary legates who had not so far held the praetorship should immediately proceed to that office, Asinius Gallus ‘altius penetrare et arcana imperii temptari’. In C.Q. N.S. xvi , 327, I suggested that this demand of Gallus’ was probably probing dangerously deeply into and perhaps threatening to wreck the carefully worked-out imperial promotions system, the working of which has been examined by Birley.
